These terms of service (“Terms”) govern your use of the Uncamera app for iPhone (the “App”) provided by Uncommon Works Ltd(“we”, “us”, or “our”).
By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What Uncamera is
Uncamera is a camera app that applies film-inspired colour grading to photos and video as you shoot. The App includes:
- A live viewfinder with built-in films, finishes, and grain
- Photo and video capture saved to your iPhone photo library
- The ability to import your own LUT files as custom films
- Themes, alternate app icons, and camera sounds
- A gallery and editor for photos taken with the App
- Optional Lock Screen and Camera Control shortcuts to open the App
Everything the App produces is processed and stored on your device. We do not receive your photos or videos. Our privacy policy explains the small amount of usage data we do collect.
2. Eligibility
To use the App, you must:
- Be at least 13 years old
- Have the legal capacity to agree to these Terms, or have a parent or guardian agree on your behalf
- Be permitted to make purchases through your Apple ID, if you buy Uncamera Pro
3. No account needed
Uncamera does not have accounts. You do not register, sign in, or give us any personal details. Your settings, custom films, and Pro status live on your device and, for purchases, in your Apple ID purchase history.
4. Uncamera Pro, purchases, and subscriptions
What Pro is
Some features are part of Uncamera Pro, a paid upgrade. Pro is available as a weekly, monthly, or yearly subscription, or as a one-off lifetime purchase. The exact features, prices, and any introductory offers are shown in the App at the time of purchase. Prices are shown in your local currency and include VAT where applicable.
Payment
All purchases are made through Apple’s App Store and charged to your Apple ID. Apple processes the payment. We never see your payment details. Apple’s terms apply to the transaction alongside these Terms.
Automatic renewal
Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends. Your Apple ID is charged for renewal within 24 hours before the current period ends. You can manage or cancel a subscription at any time in your iPhone Settings under your Apple ID, then Subscriptions. Deleting the App does not cancel a subscription.
Lifetime purchase
The lifetime option is a single payment that unlocks Pro for as long as the App is available on the App Store. It does not renew.
Restoring purchases
If you reinstall the App or move to a new iPhone, use Restore Purchases in the App to unlock Pro again on the same Apple ID.
Refunds
Because Apple handles payment, refund requests go to Apple through reportaproblem.apple.com. Apple decides refunds under its own policies. If you cancel a subscription, you keep Pro until the end of the period you have paid for.
Price changes
We may change Pro prices. Apple will notify you before a price increase takes effect on an existing subscription, and you can cancel before it applies. Continued use after a price change means you accept the new price.
5. Your photos and videos
You own everything you capture with Uncamera. We claim no rights in your photos, videos, or edits, and we never receive them.
You are responsible for:
- What you photograph and record, and for respecting other people’s privacy and the law where you are
- Making sure you have the right to use any LUT file you import as a custom film
- Backing up your photo library. The App saves to your library, but keeping copies safe is up to you and your iPhone backup settings
6. Acceptable use
You agree not to:
- Use the App for anything unlawful, including recording people where that is not permitted
- Reverse engineer, decompile, or attempt to extract the source code of the App, except where the law expressly allows it
- Circumvent or attempt to circumvent Uncamera Pro purchases or any other feature gate
- Extract, copy, or redistribute the App’s built-in films, themes, icons, sounds, or other assets outside the App
- Interfere with or disrupt the App or the services it relies on
7. Intellectual property
Ours
The App, including its software, design, built-in films and finishes, themes, app icons, sounds, text, and graphics, is owned by Uncommon Works Ltdor our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in line with these Terms and Apple’s App Store terms.
Yours
Your photos, videos, and custom films remain yours. Because they never leave your device, we need no licence to them and take none.
Feedback
If you send us feedback, suggestions, or ideas about the App, including through TestFlight, you allow us to use them without restriction or payment to you.
8. Third-party services
The App relies on a small number of third-party services:
- Apple for distribution, payment, and TestFlight beta testing
- RevenueCat for confirming and restoring purchases
- PostHog for anonymous usage analytics
Your use of these services is subject to their own terms and privacy policies. We are not responsible for their availability or conduct.
9. Beta software and availability
Uncamera is currently offered as a beta through TestFlight. Beta software may contain bugs, may change without notice, and may lose features between versions. We will do our best to keep the App working well, but we do not guarantee that it will be available, error-free, or compatible with every iPhone or iOS version.
We may update, change, or discontinue any part of the App at any time. If we discontinue the App entirely, we will give reasonable notice where we can.
10. Lost captures
Capturing a photo or video can occasionally fail, for example if the device runs out of storage, the App is interrupted, or a hardware fault occurs. We are not liable for photos or videos that were not saved, and we recommend checking your library after any capture you cannot repeat.
11. Disclaimer and limitation of liability
To the maximum extent permitted by law:
- The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied
- We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for any loss of photos, videos, data, profits, or opportunities
- Our total liability for any claim arising from your use of the App is limited to the amount you paid us in the 12 months before the claim
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded by law. If you are a consumer, nothing in these Terms affects your statutory rights.
12. Indemnification
You agree to indemnify and hold harmless Uncommon Works Ltd and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your breach of these Terms, your violation of any law, or content you capture or import using the App.
13. Apple
These Terms are between you and Uncommon Works Ltd, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Ending these Terms
You can stop using the App at any time by deleting it. Deleting the App does not cancel an active subscription; cancel it through your Apple ID settings.
We may suspend or end your right to use the App if you breach these Terms, if the law requires it, or if we stop offering the App. Sections that by their nature should survive, including intellectual property, disclaimers, and limitation of liability, will continue to apply.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the date at the top. For material changes we will also tell you in the App where practical. Continued use of the App after a change means you accept the updated Terms. If you do not agree, stop using the App.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any dispute relating to these Terms or the App is subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer living elsewhere in the United Kingdom or the European Union you may also bring proceedings in your local courts.
Before starting any legal proceedings, please contact us at support@uncommonworks.ai so we can try to resolve the matter informally.
17. General
- Entire agreement. These Terms, together with our privacy policy, are the entire agreement between you and Uncommon Works Ltd about the App.
- Severability. If any part of these Terms is found invalid or unenforceable, the rest continues to apply.
- Waiver. If we do not enforce a right under these Terms, that is not a waiver of it.
- Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours to a successor of the business.
- No third-party beneficiaries. Apart from Apple as described in section 13, these Terms create no rights for anyone else.
